You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.
Dispute Resolution
Informal Resolution: Before filing a claim against The Nash Group, LLC, you agree to try to resolve the dispute informally by contacting us at [email protected] . We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within thirty (30) days of submission, you or The Nash Group, LLC may bring a formal proceeding.
Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, including the formation, interpretation, breach, or termination thereof, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Kansas City, Missouri. The arbitrator's decision shall be final and binding.
Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law: (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated on a class-action basis; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be severed from these Terms. The validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
